TERMS & CONDITIONS - PLEASE READ THEM!



By completing your membership form, and membership payment you are confirming that you have read, understood and are agreeing to the terms & conditions and cancellation policies outlined below.



Any amendments to your account must be sent in writing to info@Liverpoolstrengthco.co.uk, where they will be dealt with and actioned within 7 days.



PLEASE READ THEM CAREFULLY


Between: You (The Member) and The Liverpool Strength Company Ltd.


Program: The Liverpool Strength Company Coaching 


1.0 General


1.1 All contracts must be paid for in advance. Memberships will not be confirmed until payment has been received.


1.2 I understand there are inherent risks in participating in a programme of strenuous exercise. If I sustain or claim to sustain any injury while participating in the programme, I acknowledge that The Liverpool Strength Co. and the coach who allocated the session are not responsible.


1.3 I will adhere to all instructions given to me by The Liverpool Strength Company.


1.4 I understand my progress is also dependent upon my effort, cooperation, consistency and adherence to the program both inside and outside of the training session’s themselves.


1.5 I understand that I will be notified of any contractual amendments with 30 days notice (for example location, billing fee amount, opening schedule) 


THE ACTION TAKERS GUARANTEE


1.5 I understand that in order to be eligible for the action takers guarantee (if appropriate) I must attend the gym and complete the allocated sessions provided by The Liverpool Strength Company, have tracked my calorie/Macronutrient targets, (and hit them) set by The Liverpool Strength Co. using MyFitnessPal for 30 consecutive days from the date of my first session and connected them to the "trainerize" or "MYPTHUB" app and completed at least two Body measurement/photo reviews.


1.6 Any requests to amend accounts should be sent directly to info@Liverpoolstrengthco.co.uk, and when received will be completed within 7 working days.


2.0 Liverpool Strength Co. Contract Duration and Automatic Renew


2.1a I understand that by completing the membership form, confirming that I am agreeing to the terms and conditions,  arranging payment, and further agreeing to the terms and conditions, I indicate that I agree with everything included in these terms, and that  I commit myself to a minimum contracted term of 3, 6 months or 12 months (depending on which option is selected) and the option selected determines the minimum number of payments which are payable, for example a 6 month contract requires 6 payments. 


2.1b I understand that this contract is in force for 6 month or 12 months (as appropriate) from the start date of the contract.


2.1c I understand that once I go past the minimum term set out in my agreement (see 2.1a) I will enter a rolling monthly agreement, by where request for cancellation MUST be received at least 28 days in advance of your next billing date


2.1.d I understand that the Online Coaching Service is a monthly rolling contract, and any request for cancellation MUST be received at least 28 days prior to your next billing date


3.1 The Member agrees to pay monthly recurring fees as follows:


Any agreed amount (as appropriate) for every months membership at The Liverpool Strength Company via recurring card payment through the Stripe payment system, direct debit through the gocardless system, and/or the Paypal Recurring Payment system.


For the Online Coaching Service, I agree to make the relevant payment through The Paypal Recurring Payment System, and unless explicitly stated in writing to Info@Liverpoolstrengthco.co.uk will proceed with payment following any trial period.


** PLEASE BE AWARE **


This contracted membership allows attendance to either a set amount of group strength and conditioning coached sessions, open gym, typically equal to 3 sessions in total, or unlimited access to group coaching sessions, weightlifting, powerlifting and yoga, as well as any other extra service we offer. In some cases an additional 1-2 personal coaching sessions per week at The Liverpool Strength Company, and any unused sessions will not carry over from week to week or billing period to billing period.


The amount of sessions you can attend will depend on your contract selection. Please choose your option wisely, as any upgrade of contract from limited sessions to unlimited sessions will break the terms of the limited sessions contract, and begin a new contract. 


For example, initial contract selection by the member is chosen as 12 month commitment for 3 sessions per week for group strength and conditioning, 6 months into the contract the member wishes to upgrade to unlimited group strength and conditioning sessions, plus all the extra modalities of training we offer, and wishes to proceed on the 12 month contract price. 


This would supersede the original contract, and begin a new 12 month contract. 



PLEASE CHOOSE YOUR CONTRACT SELECTION WISELY, AS WE  WANT TO GET YOU TRAINING AND MAKING PROGRESS. 


** IMPORTANT – READ IT! **


3.2 I agree to purchase a recurring membership at Liverpool Strength Co. as an automatic charge to my credit/debit card (or via direct debit) every month for a contract period of 3, 6 months or 12 months (as appropriate), which automatically enters into a rolling monthly contract unless cancelled by either myself (The Member) or The Liverpool Strength Co. with notification of 28 days in advance of the last contracted billing date.


3.3 I hereby certify that I am the holder of the credit/debit card/bank account detailed when signing up to this contract via Gocardless or Stripe.


3.4 I understand that my service will be deactivated if my account becomes more than 28 calendar days late.


3.5 I understand that where a membership payment fails there is a fee incurred by Liverpool Strength Co.


3.6 I understand that should there be multiple failures of my payment, for each failure there is a fee amount.


3.7 I understand and agree that where my membership payment fails, once or on several occasions, that I become liable for the payment of this fee(s).


3.8 I understand that the fee amount is 1.25% of my membership amount plus £0.20 for every failed attempt at payment.


Example:


Membership amount = £99 per month, transaction fee = £1.24 + £0.20 = £1.44 as the fee paid to process payment. For every attempt, this fee is incurred.


3 failed attempts = £4.32


3.9a I understand and agree that I am liable and will cover ALL fees that are incurred by payment failures.


3.9b I understand that I can request to amend my payment date by putting this in writing to info@liverpoolstrengthco.co.uk providing reasonable notice of 28 days.

 

4.0 CANCELLATIONS (FOR THE LOVE OF GOD, PLEASE READ THIS PART)


4.1 Request for cancellation MUST be received at least 28 days in advance of your last contracted billing date when still in the initial 3, 6 month or 12 month contract


4.1a All cancellation requests Must be submitted in writing to info@liverpoolstrengthco.co.uk and will be dealt with within 7 days of receipt.


4.2 Once entered into a rolling contract request for cancellation MUST be received at least 28 days in advance of your next billing date (example: if you are scheduled to be charged February 14th and you want to cancel for the month of February onwards, you must submit a cancellation notice to LSC by January 14th.)


4.3 Request to cancel a contract prior to the expiration of any specified commitment period (6 or 12 months) requires an early termination fee equal to 70% of the remainder your contract – a 28 day notice period still applies in this instance, so choose your contract option appropriately.


4.4 I agree that cancelling my recurring membership payment without first consulting Liverpool Strength Co. does not constitute a request to cancel membership.



4.6 Chargebacks/ DD cancellations before fixed term is automatic breach of agreement and will be referred to legal team without further notice.


4.7 Once terms of cancellation are confirmed any failure to pay remaining membership fee, without prior written consent of management, will result in an immediate referral to legal team.*

*Liverpool strength Co. hereby reserves the right to recover all reasonable legal costs associated with the enforcement of this agreement. 



4.8 Memberships that are paid in full/upfront on non-refundable.




SO, PLEASE…


Be respectful, consider your options available carefully, and if you have no intention of sticking to these terms and conditions, please do not sign up for our system.


We have bills to pay too.


We keep our word on everything we promise to deliver here at Liverpool Strength (even backed up with a money back guarantee) so we expect you to hold up your end of the bargain by honouring the terms of this agreement, the membership you have selected and cancellation policy.


4.9 These terms are NOT flexible so if you don’t intend to adhere to these terms then please DO NOT sign up.


With that being said…


4.10 I understand that I must give a minimum of 28 days notice in advance of my last contracted/next billing date (whichever appropriate) to request cancellation of this contract.


4.11 I understand that cancellation of a contract before any specified commitment period (eg 6 or 12 months) requires an early termination fee equal to 70% of the remainder the contract.


4.12 I understand that by completing payment and taking up membership at Liverpool Strength Co. via Stripe payment or Gocardless systems (or any other agreed method of payment) I am agreeing to the terms outlined above.


4.13 I understand that should I cancel my direct debit/card payment that my membership will be immediately void. And where I am still within my initial contracted period I am liable to pay the remaining 70% of my contracted choice.


4.14 I understand that my details may be passed to a legal team/debt collectors agency should I fail to give the required notice of cancellation, and/or fail to adhere to any of the outlined terms and conditions.


4.15 I accept that I may be liable to pay their fees and/or interest applied.


4.16 I understand that depending on my choice of contract I may be able to upgrade and begin a new contract.


4.17 I understand, accept and agree to the terms and conditions, and by completing my membership form and payment I am confirming that I will agree and accept to these terms.
